Here in Switzerland, there is such a ban on using cell phones during lessons; but in practice, if a student puts the phone in their schoolbag when the teacher comes to seize it, the teacher can't fish it out, because this would be an invasion of privacy.
Maybe the lack of comment by Declan McCullagh is telling of the complexity of the policy and legal issues involved.
