Part 97 says...
        4) An amateur station transmitting a RTTY or data emission using a digital code specified in    this paragraph may use any technique whose technical characteristics have been documented       publicly, such as CLOVER, G-TOR, or PacTOR, for the purpose of facilitating communications.

The key word is publically documented.

"Publically" is rather simple...and yes on a web site would be acceptable.  This has already been established by case law in the U.S.  Even if its on a web server in a foreign country...as long as the web site is accessable in the U.S.

"Documented" is another problem.  You have to ask documented to what extent.  The rule say "PacTOR" but doesn't specify I/II/III.  Since the FCC hasn't to my knowledge made any "waves" about running Pactor III, which IMHO isn't documented well, I think that something along this line would be sufficient.  OTOH, if you "publish" the source code, they there's not much more that you could do for a knowledgable programmer who would wish to duplicate your "mode."

I guess one queston is:  Where does it have to be published?  If its already
in use, and published in a foreign country, thats published.
