Or use a PC at a library? Or a friend's house? Or AOL or some other proxy server? Or prove in the negative that they didn't access what's otherwise publicly available? Etc. Just a couple of months ago it was given legal posture, for example, that the simple act of making music files available for download constituted copyright infringement.
