I'm surprised at the responses here so far. This is a pretty cut-and-dry situation. If the user is required to return documents after termination, they must provide the password. The concern of "in a recoverable form" is silly. No court would agree that a person complied with that statement if they were paper documents returned after going through a shredder.
The data on the laptop belongs to the company, end of story. Ask the user for the password. If they also use it as their Facebook password, they can change that easily before they give it to you. Don't worry about scenarios if they refuse the password until after that has actually happened -- then it's up to the business to weigh the risks, not you.
