The reason behind this problem is that TagConstants.AMPERSAND is used in the Href.toString() method that generates the URL for the sort operation. TagConstants.AMPERSAND is set to "&" so there's no way to control whether hrefs use & or &. I filed a bug on this in DisplayTag Jira.
