I wanted to post a couple thoughts on this.

first, and most importantly, situations like the one here, and by that  
I mean situations where law enforcement has made a request in one form  
or another to Tucows in relation to a domain name, will always be  
dealt with on a case-by-case basis.

there are two principals that are both true. first, Tucows has always,  
and has an obligation to, follow the law in jurisdictions in which it  
operates. second, Tucows has, and has always had, a respect for the  
rights of registrants. these things may seem to be competing  
principals and at times they may be, but in eight years and with tens  
of millions of domain transactions, we have never had a problem.

as a registrar and more importantly, as a responsible member of the  
Internet community, Tucows is regularly interacting with law  
enforcement in different jurisdictions in dealing with some of the  
seamier elements of the Internet. this means that we have  
relationships where we have mutual respect which we believe allows us  
to much more effectively ensure that the rights of all parties are  
respected. in my discussions with senior officials our reputation for  
fair dealing is always confirmed. I can't tell you how often I hear  
"we wish all registrars were as responsible as you". we believe this  
gives us much more credibility and latitude in situations that are a  
bit trickier.

there is no point in painting hypotheticals and asking us to render an  
opinion on them. it simply does not make sense. if any of you have  
specific, current fact situations that you would like help or guidance

account rep and paul karkas. paul will help you and we always like to  
keep the rep in the loop. paul will enlist adam eisner or ross or  
myself or counsel as necessary.
