With 2.6.37 I had both nodes (primary + secondary) running this kernel
with in-kernel DRBD module and it gave me the error. With 2.6.38.1 I
just upgraded only secondary and the primary was running 2.6.36.4 and
it reported the bad barrierack.

Could you try to use the out-of-tree 8.3.10?
So we know whether we have to look for a genuine bug in DRBD,
or a merge/cherry-pick mishap?

Yes, with out-of-tree 8.3.10 I no long get these errors. So there
must be something wrong with in-kernel code.
