Because it's not necessary. The mere fact that it remains loaded doesn't prevent
anything.

It shouldn't, and the X server will create the device nodes on the fly as needed.

Please provide more information such as an X server log from a failed attempt.

(Maybe the real problem is that the r128 DRM in kernel 2.4.22 doesn't
deinitialize correctly? Have you tried a DRM from current XFree86 or DRI CVS?)
