Colleagues:

Emporia State University is developing a collection in its institutional 
repository (ESIRC) for all ETDs. However, we face an issue with regard to our 
rights for theses and dissertation created between 2006-present. These items 
are currently included in ProQuest. Under the terms of our contract with 
ProQuest, the company has exclusive rights to this content. We would like to 
have a complete run of our theses and dissertations available through ESIRC, 
but we are unsure about how to judiciously address intellectual property 
aspects of this part of the collection. For those of you who have faced or are 
facing a similar situation, what approach did you take? Did you renegotiate 
your terms, dissolve ties, or do something else in order to provide open access 
to your ETDs through your institutional repository?
