Presumably any exchange provider could have such a clause in their
contract.  They may not be able to get the gold back in the case of an
inexchange, but it is very likely they could get a court order if
necessary to get money back (whether an order to make an egold spend
if that is where the other party has funds, or an order for a fiat
payment) to even things up.

At least in the case of domestic transactions....

Don't forget that the e-gold agreement does allow repudiation if
ordered by a court of competent jurisdiction.

The only question -- and it may not even be in question, depending on
relevant case law -- is whether they could convince a court that the
exchange rate was clearly erroneous and that the clause is reasonable.
(At least, AFAICT, not being a lawyer....)
