I get the same problem. As a workaround I just increased my max tabs
setting.

Subject: [Eap-list] BUG: Ordering of dropped tabs

Not sure if this has been noted, but when I open up a file beyond my
current
tab limit, the tab that disappears to replace it doesn't seem to be the
right one. I would think that the file least recently "touched" (opened
or
edited) would be killed, but it seems pretty random which one
disappears. I
got into a situation yesterday where I opened file A (which filled out
my
tab limit), then opened file B to check on something, and file A
disappeared.
