Both parties ante up and are given a reasonable but firm deadline to begin. If the time expires, the monies go back to the parties and the interest goes to a public defense charity. If one party wins then they get the spoils, plus interest, plus whatever actual legal fees can be proved above the ante (interest is always a bonus to the winner).
