Eh eh solved, I was just using the builtin emacs version on snow leopard
(22.1), which for some reasons don't work at all..

This is enough, now I'll have to play with getopt a little bit
--8<---------------cut here---------------start------------->8---
FILE=$1
ORG="$HOME/.emacs.d/org-mode/lisp/"
EMACS="/Applications/Emacs.app/Contents/MacOS/Emacs"

if ! test -f $FILE
then
    help
else
    echo "converting file $FILE"
    $EMACS   --batch \
        --eval "(add-to-list 'load-path \"$ORG\")" \
        --eval "(require 'org)" \
        --visit=$FILE --funcall org-export-as-latex-batch
fi
--8<---------------cut here---------------end--------------->8---
