Which version of Mail do you need to do this? I have v. 1.3.9
(v619), on OS X.3.5. I miss this feature in Mail.
I'm using 10.4 with Mail v2.1.1.
I don't have a 10.3 machine handy with the earlier version of Mail,
so I can't say if the Smart Mailbox option is something added with
Mail v2 or not. It might have been.
I can say, in my version of Mail, if you go to the Mailbox menu,
there is a menu option for Smart Mailbox.
