Without testing, I can't actually tell you which end was at fault. It
could be that when Emailer tried to encode the data fork, found
nothing, that it simply moved on and never created the "attachment"
at all.
So the fault may not lie with Mail, as there may have been no record
of the zero length attachment to begin with.
