I am not aware of any bug in this version, but what could be possible is,
that the Embperl binary is for an older Apache or mod_perl version, so they
fit not well together.

You need the Apache header files. If they are not installed somewhere
(search for httpd.h), you must download the Apache sources (make sure it the
same version as the binary you have installed). The run the normal perl
Makefile.PL and when you get asked for the sources of Apache enter either
the directory where you found httpd.conf or where you extracted the Apache
sources.

If you compile a version of your own, take the newest Embperl version from
the CVS, because I have made some changes that might also affect the
behaviour under ActiveState Perl.

P.S. Most people using Embperl /mod_perl on Windows don't uses ActiveState
Perl, but have compiled there own Perl (because mod_perl didn't work for a
long time together with ActiveState Perl). So mod_perl + Embperl +
ActiveState Perl isn't so well tested yet, so it might be a problem that
only occurs with ActiveState Perl.
