Ok, to checkout an old version you use the commit hash, like this:

git checkout c7281fc7fb4b99af3875308902eae2045ba2eb11

Having done this, an excerpt from the README:

"EMC2 is an offshoot of the original NIST Enhanced Machine
Controller.  The new version is (primarily) a GPL'd project."

So, sometime between January 17th, 2001 at 11:45:00am EST and October
11th, 2003 at 4:30:53pm EST the EMC project licensing changed from
Public Domain to (primarily) GPL.

Does anyone have a backup of source code from between these two dates?
