I believe that OSHA enforces the CDRH laser safety guidelines in the
workplace.  I'm not sure about consumer goods...Possibly the Consumer
Product Safety Commission?

Penalties for non-compliance would be the typical fines, recalls ...
handed out by OSHA or CPSC.
