I am glad you took second look at the WPC Notification but we do NOT agree
with your interpretation of the rules.
 
Please see email comments below from Leslie Bai, our expertise on
international approvals, and I also confirmed with our SISC - SIEMIC India
Service Center, that the approval is MANDATORY!

Hi Jeff, One shall understand the difference between "License of using
wireless equipment" and "Certification of Wireless Products". WPC Note Item 3
states that "License is not required to use 2.4GHz devices", this does not
mean the used devices do not need "Certification". Basically, India WPC Notice
says, 2.4GHz is unlicensed band, i.e. no license is required to operate at
this frequency band (Defined in Item 3: Use of Wireless equipment), but 2.4GHz
device is still required for Type Certification (defined in Item 6: Equipment
Certification).

WPC is a spectrum allocation body. Their certification is not needed for India
but can be applied for on a voluntary basis.  There are no mandatory approvals
needed at this time. It is ok to sell in India with the existing FCC/European
test reports. If cord connected, make sure the power cord has an ISI mark from
BIS.
