Since the FCC range of frequencies is limited to 9 kHz-275 GHz, there is lots of frequencies outside of that. There are a number of military bands within that range also. The table mentioned is coordinated internationally to reduce interference. 2.102 Assignment of frequencies. <htt ://ecfr.gpoaccess.gov/cgi/t/text/text-i x?idno=47;region=DIV1;type=boolean;c=ec r;cc=ecfr;sid=9f4d1dcf8697f1bfb7fee2177 08265c;q1=frequency;rgn1=Part;op2=and;q =part%202;rgn2=Section;op3=and;rgn3=Sec ion;rgn=div5;view=text;node=47%3A1.0.1.1.#PartTop> top (a) Except as otherwise provided in this section, the assignment of frequencies and bands of frequencies to all stations and classes of stations and the licensing and authorizing of the use of all such frequencies between 9 kHz and 275 GHz, and the actual use of such frequencies for radiocommunication or for any other purpose, including the transfer of energy by radio, shall be in accordance with the Table of Frequency Allocations in ยง2.106.

If it uses only military frequencies or frequencies not controlled by the FCC then the FCC has no say as that would fall under other branches of government. If there are specific cases where the FCC and military have agreed about a specific device that would be different; but it would not apply to all intentional radiators that would normally be under part 15 and would apply only to the specific device. I am not aware of any such agreement.
