Ron,
  In general, the labhelp address at the FCC should be used for questions - I
know they generally resist answering questions addressed to individuals.  If
you've used this without a response, the specific answer must still be under
discussion.  If this is for a handheld mobile computer that can be held to the
head for voice communications, from direct experience I can say that the rules
apply.
 
For normal cellular (GSM/UMTS or CDMA) the FCC does require HAC compliance if
the product can be held to the head.  Note that if a single device has
multiple air interfaces (GSM and UMTS, for example), then the device counts
towards your total model count for each individual interface.

For WiFi interfaces the test spec is in development so there is not a current
test requirement.  Recent FCC guidance is that the device is considered
compliant if the following two conditions are met:  1) the device is HAC
compliant for all other interfaces in the product (e.g. GSM/UMTS).  2) the
labeling must disclose that the device has not been rated for WiFi usage.
