The exact situation under the EMC Directive is that there is nothing to 
stop this being done. In fact, there is no demand for testing at all. 
What is required is that the manufacturer gives an assurance that the 
Directive is complied with.

So, if you are SURE that the updated standard is complied with, go ahead 
and cite it.
