Mike,
The software will be inaccessible to the user, to the extent this is possible, 
and the final assembly and form factor would not lend itself to “hacking”.  The 
end user would have no visual cues of the radio circuitry’s existence.

To your question of risk, if the finished product was consumer electronics of 
some sort I think the risk of unauthorized enabling of the radio could be 
considerably higher for a number of reasons.  However, at the same time I’m 
guessing that software de-featuring of high volume electronics is rare because 
it is simply too expensive to ship unused (radio) components when the profit 
margins are so thin.  The product system I was asked about would be very low 
risk, in my estimation.

My thoughts ran to FCC regulations first, where radio products must identify 
the FCC ID on product label and in documentation.  Is this still required if 
the radio part doesn’t work?

At any rate, as Mr. Woodgate points out the manufacturer is left (once again) 
to argue and defend his or her position.

I was asked an interesting question recently that I’m pretty certain has the 
standard compliance “it depends” answer:
*Is a radio product with all radio functionality intentionally disabled via 
external software load still considered a radio product?

The intent is to repurpose a common electronic HW assembly containing an 
embedded radio as a non-radio finished electronic product.  The finished 
electronic product will be incorporated into a much larger final machine 
assembly where the radio is not needed.  In this particular case it is 
apparently easier and more economical to disable the radio function with 
software load than to modify the subassembly hardware BOM.

*Must products that contain disabled radio function (by way of HW or SW) be 
disclosed as radios, and if so, which countries require the disclosure?

I’m withholding my thoughts in order to be brief, however, I’m hoping the 
experts in this matter will release the hounds and wax eloquently.
