They got away with it for years, because the EU emissions certification 
program is pretty much broken. Remember, VW was collared not in Germany (fat 
chance), but right here in the US.  Clearly, "regulatory capture" isn't 
unique to the US.

This may be one reason that much of Western Europe is now pushing hard for 
EVs and against Diesels. 

Please correct me if I've misstated anything in this post.
