SCO is saying one thing in public ("Linux stole our System V code!"),
but quite another in it's lawsuit against IBM. The lawsuit says that
linux has lots of lines of code that were written by IBM (JFS,
Scatter/Gather IO, and RCU) but IBM was not free to release it because
it is a derivative work of System V unix and because of some contracts
SCO had with IBM concerning an aborted joint Intel based unix called
Monterrey.The derivative works argument works pretty good in the literary world for which it was intended. You can't, for example, write a book using the characters and settings from Harry Potter without working out a deal with Ms. Rawlings. In the software world, though, the derivative works argument pretty much falls flat. It would be akin to Microsoft claiming that they had rights to every Excel macro ever written. Pretty silly if you ask me. Even sillier considering that AT&T explicitly told unix licensees that licensees' code was NOT encumbered by the unix license. Still sillier yet, is that the JFS code that IBM contributed to linux was developed for OS/2, not AIX. Scatter/gather IO was a feature of IBM operating systems before unix was even born. RCU was implemented by SGI before IBM bought them. Slashdot.org has several stories on the SCO goings on. Groklaw has some good, rational analysis from a legal perspective. It's a valid suit, assuming that there are line by line similarities in the source code. The bigger issue with it is what constitutes copyright infringement in software development. That's the sticky question to answer.
