That would be determined by analysing the logs, collecting the IP addresses, then doing a systematic lookup of each ISP's TOS/AUP in relation to dynamic/dhcp addresses being permitted to send mail directly subsequently bypassing the provider's desinated MX server. For my system, that has been 1 false positive as confirmed by the ISP in question in a 5 year period. This will be different per each system as each administrator has the ability to select what they consider dynamic or not in the configuration file.
