Perhaps. But that still seems to miss the point. Rove could have gotten the info in any number of ways. The technical point that seems lost in all of this is that if Rove did not have a formal clearance (a forma CIA piece of paper) from the CIA for the security level required to access information on the IDs of covert ops (a very high level of clearance I assume and not give out lightly), then under the statute, Rove can not be prosecuted.
