Then it will go back to any prior contracts, and who actually owns the trademark. My guess is that he won't be able to advertise atthe least, and the TMO may have to buy him out, but if the court actually orders him to accept payment for his loss of use of the trademark, he's SHOL. And, unless the TMO loses ownership of the trademark, I can't imagine any judge ruling that the owner of the trademark can't control who uses it in a commercial setting. Note that I'm not a lawyer, but this is the most obvious common sense way for these things to be dealt with so unless the law gets REALLY convoluted, I suspect that that is what will happen. ------------------------ Yahoo!
