imo would probably be shot down in Ct by persons or organs trying to trademark the term since so many parties have already gotten into it. Thus, it's a common term that probably can't be trademark, more descriptive of a practice in a historical context rather than something specific to an organization or individual. But such definitions have a big gray area in that orgs or persons may attempt to trademark "Mindfulness" on some phony grounds, much as Eckankar trademarked "Soul Travel". Anybody is free to attempt to "travel in their Soul": (i.e. out of body travel), but the Eckankar founder got away with getting the trademark. ... Likewise, the TM org got away with "Transcendental meditation" even though one can argue that these terms are overly broad and have a history going back thousands of years in countless sects.
