Only licensed gear may be operated on the ISM bands, and only licensed amateurs are allowed to build their own unlicensed transmitters for operation on the amateur bands. Sometimes the bands overlap. You can try transmitting anyway, and if you use low enough power then probably no one will notice. But if you send splatter all across the bands then spectrum enforcement agents and/or (steamed) hams may come knocking on your door with subsequent confiscation of gear and a fine.
