As far as I know, this bug has not been fixed, even in 2010, probably because it is seen by MM as a minor annoyance that can be avoided simply by not reconfiguring the tool pallet. I can't begin to relate how long this one plagued me, before MM figured out where the problem was. I leave the tool pallet alone now and have simply gotten used to its default configuration.
