I seem to have narrowed in on the problem
xchat needed a couple of virtual depenencies which would not download.
once I reinstalled xfree...rootless and did selfupdate-cvs and then fink upate-all all was well.
btw I a using the jag version of fink...
believe the latest gnome-vfs package is temporarily not available.

I picked 1 again as the default and then fink said:

I've tried this picking 2 for each selection getting the same results.
I went on the Fink irc channel and some nice folks there suggested it
was a bug.
does anyone know how I can fix this?
