What got removed with your OS update was the headers in /usr/include, 
but the executables were still present.  The fink bootstrap procedure 
currently checks for the presence of these executables, and it therefore 
found nothing to indicate that it should stop.

A change which tests the command-line tools version at bootstrap time is 
likely to be part of the next release.

I'm sorry that Apple didn't document that.  We don't have any control 
whatsoever about what they do or don't do.

_We_  either running the command or downloading the tools from Apple in 
our online and bundled documentation (English only, unfortunately, due 
to a lack of resources).  We wouldn't have told you to run a command 
without the presumption that it would work for you.
