At least, in the Atlanta area, this is not the case. Cable modems deployed
in the area not only send data in the clear, they are very sniffable with
the proper software.

Subject: Cable modems
Folks,
A number of people have been asking about cable modem security.
Most cable modem products I am aware of perform MAC layer encryption which
would presumably alleviate some of peoples concerns but not all. Certainly
for all the most recent DOCSIS compliant modems (see www.cablemodem.com)
pretty much mandate encryption. Probably if you ask your service provider
they will be able to verify what the nature of that encryption is.
There has been a fair amount of bad mouthing of Cable modems by operators
deploying ADSL solutions so don't believe the hype.
Cheers
John
