Ok, let me put it this way
My LAN engineers observe, monitor, and control our network. 
The key words here are control our NETWORK ! not our people.
I repeat, if my employees are doing their job and not causing me liability
issues, then I leave them alone.  
   I don't give a rat's ass if my Sales staff, having burned their quota
twice over with 3 weeks left in the quarter, chooses to evaluate and shop
for their new cars on-line, nor if my Marketing staff, having provided more
hot leads for next quarter than my sales staff  can reasonably expect to
handle, engage some of my LAN guys (or gals) in a quake game.
If they have/are doing their jobs, then they are welcome to relax in
whatever small amounts of time they have left.

-Is my business running and growing according to plan ?
- Is my network under control (safe, secure, and utilization is
"reasonable" so that those of us still not done with our deliverables can
deliver them) ?
- Are my customers happy ?
- Are my employees happy ?
        If so, then the only reasons to be a pain in the ass to my employees are
spite, paranoia, and that 1950's attitude I so "love"

And by the way, if you restrict ICQ (or anything else) to a series of
ports, you can watch them and deny suspicious traffic.  No one has ever
gotten upset if ICQ was unavailable for an hour or two.

ICQ is "the poster child" now.  In two years it will be something else.  It
is enough work defending our network from deliberate sabotage, outside
interference and espionage, without wasting my time playing big brother .
External Liability is a legal issue and can be defended against.
Internal Liabilities are also legal issues and can be also be defended
against with a clear and complete rules acceptance signed upon hire.
Use of ICQ is nor more a threat than email, "work related HTTP, FTP, etc".
If you can't live with technology, get out of the business 'cause it only
gets worse.
And just for the record, anyone who has fired an experienced productive
employee simply he used ICQ or shopped on-line, please send me his resume.
Our company and others in the area are always looking for productive
employees. They are scarce.
