Hi, sorry I missed this one earlier...
Once we have released the Flex SDK as open source (which will happen at the same time as final release of Flex 3) you will be able to distribute the compiler with your application. However, before then (including with Flex 2) this is not allowed without a specific license (which we're actually not really granting any more of right now because they take forever to work out and we have Flex 3 coming, etc.).
