What I do believe you've succeeded in showing here is that the whole issue is far from clearly drawn. What I don't believe is that the arguments you've offered are more than voodoo analogies. For example, the GPL in any version isn't "trumped" by federal law -- unless, of course, you mean that some federal law rules out using some software entirely. That's possible.
