Hmm, not sure about that. I think they just insist on a consistent look. 
As I understand it, there are several cross platform libraries 
(iPhone/Android) around which emulate the look of each platform as much 
as possible (Corona UI comes to mind) - they are commercial though. It 
seems that such apps make it to the app store.

So if fltk with some derived, natively looking widgets were used, I 
believe there wouldn't be a problem. But then - I am not a lawyer. It 
would be worth a try though...

In fact, I would be interested in having a "developer version" of fltk 
running on i-devices. That would be a reason to get one ...
