Yes, we from Access to Information Programme (Bulgaria) had prepared a lot of 
commentaries, reports, handbooks on access to environmental  information. Some 
of these materials are only in Bulgarian language. I am sending a Resume of our 
report on assessment of access to information, public participation in 
decision-making and access to justice on environmental matters (three pillars 
of Aarhus Convention - http://www.unece.org/env/pp/) in Bulgaria which we from 
AIP performed in 2004. I am sending also the handbook on access to 
environmental information.

I?m writing a study and I would like to ask for you help in two questions in 
the field of classification/state secrets. 



There are countries where sensitive information is not necessarily classified 
immediately upon creation, it is classified only when the public body holding 
the information receives a request and assesses the request. 



For example the Mexican Regulations of the Federal Transparency and. Access to 
Public Government Information Law article 26 prescribes: ?The  departments  and 
 entities  administrative unit  principals  will  classify  the  information 
when:
I.  The information is generated,    obtained, acquired or transformed; or
II. A request for access to the information is received, in the case of 
documents with no
previous categorization.? 

(Reglamento de la Ley Federal de Transparencia y Acceso a la Informaci?n 
P?blica Gubernamental.
?Los titulares de las unidades administrativas de las dependencias y entidades 
llevar?n a cabo la clasificaci?n de la informaci?n en el momento en que:
I.Se genere, obtenga, adquiera o transforme la informaci?n, o
II.Se reciba una solicitud de acceso a la informaci?n, en el caso de documentos 
que no se hubieran clasificado previamente.?)

In a rule of law system the criminal law has to operate with exact terminology, 
analogy is prohibited. ?A norm cannot be regarded as a "law" unless it is 
formulated with sufficient precision to enable the citizen to regulate his 
conduct: he must be able - if need be with appropriate advice - to foresee, to 
a degree that is reasonable in the circumstances, the consequences which a 
given action may entail.? (Sunday Times v. United Kingdom case)

Question 1: In those rule of law countries where information is not classified 
immediately upon creation how does the criminal law sanction unauthorised 
access to or leaks of sensitive but not yet classified information? If there 
are no protective markings, according to classification rules, how can one know 
that it is a crime, to read, publish, etc. that information?

Question 2: In those countries where information is not classified immediately 
upon creation how can information be adequately protected? Is every piece of 
information protected as top secret or practically they are not protected at 
all, as the level of protection needed is not assessed upon creation?
