Can someone from Brazil confirm this rough Google translation of the recent
judicial decision that held Banco Nacional de Desenvolvimento Economico e
Social (BNDES) is not subject to FOIA because of banking secrecy laws.

The Federal Court in Brasilia said, a decision is still provisional, the Banco
Nacional de Desenvolvimento Economico e Social (BNDES) is not directly subject
to the Access to Information Act - so would not be required to disclose all
data on granting loans to companies and public entities.

The judge of the 20th Federal Court of Brasilia, Adverci Rates Mendes de Abreu,
denied a request for an injunction in action the Federal Public Ministry (MPF)
for the BNDES disclose, within 60 days, information about all transactions with
public money made in recent ten years and going forward.

For the judge, how these transactions affect bank customers, the effects of the
publication would be "irreversible." "In the face of the subject matter, which
involves bank secrecy and business of parties not part of the deal, it must be
the rejection of anticipatory measure," says the decision.

In the civil action, the Attorney General's Office in the Federal District
indicates a lack of transparency in the operations of the BNDES and asks the
following explanations: shape and condition of obtaining the funds, criteria
for defining where the money is invested, risk, terms, interest rates charged,
warranties and payoff.

BNDES claims that the data are confidential because they affect the financial
situation of private, protected by bank secrecy. Already MPF says that
confidentiality does not apply when there is public money involved. The MP
accuses the bank violate the Access to Information Act (Act 12.527/2011) and
the principles of transparency, efficiency and morality under the Constitution.

In denying the injunction, the judge Adverci Abreu says that "the case is not
subject directly" to the Law on Access to Information, since BNDES "is a
federal public company, with private legal personality and its own patrimony" .

According to her, the bank's activities are protected by a caveat Decree
7.724/2012, which guarantees the confidentiality of data "to the business
activity of individuals or legal entities of private law (...) whose disclosure
would represent a competitive advantage other economic agents. " The merits of
the case, however, has not been reviewed.

The BNDES said in a statement that the value "has a policy of providing as much
information as possible about its activities and operations, while respecting
the legal limits."

Noticia ontem nos jornais que pode mudar o trabalho de transparência com BNDES,
infelizmente de forma regressiva.
