Same issue exists with the igb drivers (IGB_LEGACY_TX). Really there should be tunables for enabling the LEGAXY_TX paths. Currently you have to modify the driver or include IXGBE_LEGACY_TX as a build option before building the kernel and/or driver module (easier said than done).
