Sorry, just found by myself. I included these lines before the do-install 
section:

.include <bsd.port.pre.mk>
.if ${OSVERSION} < 1000100
IGNORE=         runs only on FreeBSD 10.0 and newer
.endif


IGNORE_FreeBSD_9=     This version only for FreeBSD 10+
