To end that violation they only had to include the GPL and an offer to
provide source code along side, they were distributing binaries of pure
GPL code and not offering source in any form for GPL work.

No patches were involved.

So you can provide upstream download sources aslong as you offer to
provide sources yourself on request. 

If Asus are doing neither then they are in GPL violation, but they still
don't need to provide their work which means the GPL isn't much use in
getting your front panel code.
