This is a very dangerous assumption. Remember that the admissability of
the evidence was enough to ensure a severe conviction and he had lost
his 9th Circuit appeal on the matter. He wasn't likely to get a more
generous ruling from the Supreme Court. It's reasonable to believe he
was just making the best of a bad situation even if he was innocent.
