This will almost certainly go nowhere, for the exact same reason that most of the lawsuits about warrantless spying went nowhere - nobody can show proof they were actually spied on and therefor have standing to sue as "plaintiff who was spied on". Every single one of the warrantless spying cases went bye-bye except for one law firm that got hold of an accidentally released document showing that they were in fact targeted.
