Andy,
I would suggest that you're misconfigured - I'm also using FW-1 4.0 and in
my tcp-high-ports definition the port is listed as ">1023".

I searched the archive to no avail.
In the service definition for tcp-high-ports in the FW-1 4.0 default
configuration, there is only a single port listed. That port is "1023".
There is no greater-than sign (">1023") or anything else that would identify
ports higher than 1023.
Is this proper? Or am I misconfigured?
