And the converse is also true-- leaving it open, the guys come without a subpeona (in this kinder gentler nation we have now there's no need for pesky rule of law) and you can shrug and say "could be anyone".

I read of someone who was taken to court for an attempted DOS or "hack attempt" of some sort and he showed the court that it could have been one of any number of viruses/etc. taking over a CPU to do the same thing, and they agreed and the case went away. I'm amazed he had a judge that was able to understand the tech details (see
