I cannot comment on the legal agreements between the author and his company.
However, the general policy for the CLA is that it should be singed by
whoever
is the copyright owner; if it is the original patch author, an 'individual'
CLA should be signed by the author, if the copyright owner is the company,
the 'corporate' CLA should be signed by a representative of the company.
