Here is an excerpt from a recent AP new article which referenced a 1998
grand jury investigation of Sandusky. He should have been jailed long before
the 2002 incident could have occurred.

Curley denied that the assistant had reported anything of a sexual nature,
calling it "merely `horsing around,'" the 23-page grand jury report said.
But he also testified that he barred Sandusky from bringing children onto
campus and that he advised Spanier of the matter.

The grand jury said Curley was lying, Kelly said, adding that it also deemed
portions of Schultz's testimony not to be credible.

Schultz told the jurors he also knew of a 1998 investigation involving
sexually inappropriate behavior by Sandusky with a boy in the showers the
football team used.

But despite his job overseeing campus police, he never reported the 2002
allegations to any authorities, "never sought or received a police report on
the 1998 incident and never attempted to learn the identity of the child in
the shower in 2002," the jurors wrote. "No one from the university did so."

Your theory sounds quite possible Zeb, but we have also heard there was a
1998 grand jury investigation which did nothing, right? And who reported
what in 1998? This has been going on so long it is just crazy.

He is the key witness for the prosecution. People who testify against their
higher ups often are not prosecuted.

I don't know that answer, but would point out a few tidbits from the
perspective of an attorney.

Several articles mention that the failure of a University to report possible
child abuse (and that is putting it way too gently) is a Federal offense.

The Feds have a whistleblower statute to protect the job of the person who
turns in the offender.

No one has mentioned who finally brought this matter to the attention of the
authorities after all of these years.

The PSU Trustees have not only affirmed that McQueary will neither be fired
nor demoted, they have also taken affirmative steps to protect him.

If I had to speculate, I would go with the theory that McQueary's conscience
finally got to him, he reported the events to the authorities, and that he
is protected under a state or Federal whistle-blower statute.
