The issues of consent and agency that this judgment raises are significant, especially since some of the women's organisations affiliated to the right wing of Indian polity continue to spout the fact that 'bharatiya naari' are:
(A) only sexual after a proper seven-phera marriage since that is proper Indian culture, (B) that women are never ever willing participant in any sexual act (other than after solemnisation of above said marriage) since that is not Indian culture (in any event men are the ones with the decision making capacity, in their world view), and (C) finally that if ever it comes to light that the woman has actually had a sexual relationship outside of the bounds of culture as describe above, then she must be the victim of the man's wiles!! Happily the court does not fall for that bull crappy narrative!
